EXTERNAL PERMANENT TRADE – 2009/10 season
from Murrumbidgee Irrigation Licences

Murrumbidgee Irrigation Permanent Trade rules for the 2009/10 season will be effective from 1 July, 2009. A copy of these rules will be posted to all customers from the week commencing 29 June 2009.

Murrumbidgee Irrigation will be accepting applications for permanent trade of Water Entitlements in the 2009/10 season in accordance with the protocols contained in this notice and the Entitlements Trade Rules, on or after Monday 20 July, 2009.
               
All applications submitted, will require a statutory declaration from the legal representative of the purchaser, certifying:

  • the date of exchange of sale contracts, and

  • their opinion as to whether the application is or is not caught by the Ministerial Order under section 71Z(1) of the Water Management Act 2000,  Access Licence Dealing Principles, of 29 May 2009.

The identity and role of the signatory in the process must be clearly identified on the declaration.

ACCEPTING APPLICATIONS and PROCESS TO APPROVAL

  1. For contracts exchanged on or before 29th May 2009
    Will be allocated sequence numbers based on date of exchange of contracts.
    Will be processed to approval in sequence order,
    Will be included in the count up to any annual limit in place, by sequence number.
    To be included in this section, documents must be submitted by 5:00pm 21st August 2009.

  1. A.    For contracts exchanged after 29th May 2009 and before 25th June 2009
    Will be allocated sequence numbers based on date of exchange of contracts
    To be included in this section, documents must be submitted by 5:00pm 21st August 2009.
     
    B.    For subsequent applications received by Murrumbidgee Irrigation
    Will be allocated sequence numbers based on date and time of receipt.

For those not caught in the NSW Government embargo
Will be processed to approval in sequence order,
Will be included in the count up to any annual limit in place, by sequence number.

For those caught in the NSW Government embargo
Will retain their sequence number
Will not be processed while the embargo is in place
Will not be included in the count to any annual limit in place while the embargo is in place.
When embargo is lifted:
Will be processed to approval in sequence order
Will be included in the remaining count up to any annual limit in place by sequence number.

  1. Transfers under accredited water efficiency savings programs, unless caught in the embargo, will be processed to approval, and will be outside any annual limit in place.

  1. Applications received in excess of any annual limit in place will be allocated sequence numbers based on date and time of receipt, and will be queued for future consideration and approval.
